APPLICABILITY OF REGULATIONS

In addition to the provisions contained in the Maharashtra Regional & Town Planning Act, 1966, Nagpur Improvement Trust Act, 1936, the city of Nagpur Corporation Act, 1948 and Maharashtra Apartment Act, 1963 as amended from time to time these regulations shall apply to the building regulation activities.

These regulations shall apply to all 'development'.  Further these regulations shall apply to development work.

Where a building is erected, these Regulations apply to the design and construction of the building.

Part Construction - Where the whole or part of a building is demolished are altered or reconstructed, removed, except where otherwise specifically stipulated, these Regulations apply only to the extent of the work involved.

Change of Occupancy - Where the occupancy of a building is changed, except where otherwise specifically stipulated, these Regulations shall apply to all parts of the building affected by the change.

Reconstruction - The reconstruction is whole or part of a building which has ceased to exist due to an accidental unsafe, or which is likely to be demolished by of under an order of the Corporation or the Nagpur Improvement Trust or the Nagpur Housing and Area Development Board and for which the necessary certificate has been given by either the said Corporation or Trust or the Board, shall be allowed subject to the Regulations.

Exclusions - Nothing in this Regulations shall require the removal, alteration or abandonment or prevent the continuance of the lawfully established use or occupancy of an existing building or its use unless, in the opinion of the Chairman/ Commissioner, such a building is unsafe or constitutes a hazard to the safety of adjacent property.
