BUILDING PERMIT AND COMMENCEMENT CERTIFICATE REQUIRED

No person shall carry out any development, erect, re-erect or make alterations or demolish any building or cause the same to be done without first obtaining a separate building permit and commencement certificate for each such development work/ building from the authority.

The following operational construction of the Government, whether temporary or permanent, which is necessary for the operation, maintenance, development or execution of any of the following services may be exempted from the provisions of these regulations.

  1. Railways;
  2. National Highways;
  3. National Waterways;
  4. Airways and Aerodromes;
  5. Posts and Telegraphs, telephones, wireless, broadcasting and other like forms of communication,
  6. Regional grid for electricity and 
  7. Any other service which the State Government may, if it is of opinion that the operation, maintenance, development or execution of such service is essential to the life of the community, by notification, declare to be a service for the purpose of this clause.

However the following constructions of the Government department do no come under the previous of operational construction for the purpose of exemption.

  1. New residential building, roads and drains in railway colonies, hospitals, clubs, institutes and schools, in the case of railways; and
  2. A new building, new construction or new installation or any extension thereof, in the case of any other services.

In the context of regulations No. 5.1.1.(i) and 5.1.1.1(i) for the purpose of deciding what constitute 'Operational Construction' the following may be used as the basis:

  1. Repairs, renovation etc, to the following works in the existing installations, buildings etc. of the Railways.
    1. All Railways tracks in and outside the yards including the formation, culverts, bridges, tunnels and side drains.
    2. Building, Platforms, foot over bridges, subways, sheds over platforms, yard, master's and train dispatcher's offices, weight bridges, turn-tables, lifting-towers, gantries.
    3. Running (LOCO) sheds, carriage and wagon deposits, carriage washing arrangement, running rooms, Train Examiner's office and depots in the yards, permanent way inspector's and Signal Inspector's Stores in the yards, water tanks overhead and ground level, pipe lines and pumping stations.
    4. Goods sheds, parcel offices, goods platforms.
    5. Store sheds, sub-stations.
    6. Signals, signal cabins, control cabins in humping yards.
  2. Fencing or walling for protection of railway lines and yards.
  3. All over head electric equipment for electric traction

Note:

  1. In the case of new railway lines, the Railway Administration should make a reference to the State Government for their views which will be given due consideration by the Railway Administration, before finalising the project.
  2. For the construction of new station building, goods sheds, parcel offices, foods platforms and workshops or their major remodelling, as distinct from repairs, renovations etc., referred to under Item (i.) (a) to (f) above, reference to the Appropriate Authority will be necessary.
 Pre-code building permit :-
  1. Validity of development permission :- If a development permission has been issued before the date of common cement of these regulations but the development is not started within a year from the date of such permission the said development permission shall be deemed to have lapsed.
  2. Applicability to partially completed work :- for partially completed works, started with due permission before these regulation have come into force, the Commissioner/ Chairman may not for extending the period of the development permission, which shall not exceed than specified in section 48 of the Maharashtra Regional and Town Planning Act 1966.
