Q. 1:  What are restrictions regarding transfer of Class-II occupancies ?

Ans:  Class-II occupancies are not transferable by way of sale,gift,will etc. without the prior permission of the competent authority. Such lands however can be mortgaged in favour of Nationalised Banks and Co-Operative Credit Societies for raising loan for Agriculture without any  Permission.(Maharashtra Land Revenue Code 1966  sec.36(4).

Q. 2: Which lands fall in the category of Class-II occupancies?

Ans: Occupants Class-II shall consist of persons who hold unalienated land in perpetuity subject to restrictions on the right to transfer; immediately before the commencement of Maharashtra Land Revenue Code 1966 (i.e.prior to 15th August 1967) Hold -land in Vidarbha in Bhumiswami rights with restrictions with restrictions on the right to transfer or in Bhumidhari rights under the Madhya Pradesh Land Revenue Code 1954; and elsewhere hold land in occupancy rights with   restrictions on the right to transfer under any other law relating to hold revenue ; and before the commencement of this Code have been granted  rights in unalienated land under leases which entitle them to hold the land in the perpetuiety, or for a period not less than fifty years with option to renew on fixed rent,under any law relating to land revenue and in force before the commencement of this Code; and all provisions of this Code relating to the rights, liabilities and responsibilities of Occupants- Class-II shall apply to them as if they were Occupants-Class II under this Code.(Sec.29(3) MLRC 1966.

Q.3:  How permission to transfer Class-II occupancy can be Obtained?

Ans: A) N. A Plots :- Collector can grant the permission to sell N. A.Plots held as occupant Class-II on payment of  Premium equal to 50% of unearned income(i.e. difference between sale price approved by the Collector and the original price paid to Govt.plus value of improvements, if  any.

       B) Regulation of unauthorised sale:- Unauthorised sale of N. A. plots held as Class-II may be regularised by charging 65 to 75 % of unearned income. Agricultural land:- Agricultural land distributed by The Govt. is generally held as Class-II occupancy. For transferring such lands permission of Divisional Commissioner is necessary, which can be given by charging 50% of unearned income for agricultural purpose and by charging 75% of unearned income for Non-agricultural purpose. Permission for transferring  Such land by way of gift or for purblic purpose or to charitable trust for cultivation can be granated by District Collector. Conversion of tenure:- Permission can be granted by the Commissioner to convert the tenure from occupant class-II to class-I for occupants own residential or industrial use (and not for subsequent sale) on payment of premium equal to the present market value of similar land minus three times or the number of times assessment or occupancy price originally paid by him plus present value of improvements, if any.

      Bhumidhari land:- Sub-Divisional Officers(Revenue) : Are authorised to issue orders of inclusion of  Bhumidhari class-II holders from Vidarbha into class-I on payment of premium equal to 3 times,   and after a proclamation and an inquiry. These provisions are not applicable to other class-II  occupancies. Breach of Condition:- Class-II occupancies are liable To be forfeited to Government in the event of violation of  condition of grant. Some breaches and voilations, however can be regularised on merit of the case on payment of  premium upto 75% of the unearned income.

Q. 4:  What are policies of Govt. of Maharashtra regarding Natural Calamities and releif measures?

Ans:

1. Meaning:  Earthquake, floods, fires, cyclones, lightings, landslides, hail storms, high sea tides and waves, heavy rains (more than 65 mm. Within a spanof 24 hours).
2. Nature & scale of assistance:
  Gratuitous relief to destitute persons Rs. 600/- per head.

Financial assistance to relatives of deceased persons on account of a natural calamity Rs. 50,000/- for all calamities except lightening. And Rs. 10,000/- per death In case of death due to lightening.

Upto Rs. 9600/- towards loan and upto Rs.2400/- towards subsidy for repairs in case of partially of damaged houses.
Upto Rs. 12000/-towards loan and upto Rs. 4800/- towards subsidy for reconstruction in case of fully damages houses.
Upto Rs. 900/- towards loan and upto Rs. 2700/- towards
Subsidy for reconstruction of huts.

50% of actual loss but limited to Rs. 500/- as subsidy and remaining amount of loss as loan but limited to Rs.5000/- for vocational rehabilitation of small traders,self employed and fishermen. Affected persons having annual income more than Rs. 10,000/- are not eligible for financial assistance.

Financial assistance by way of free seeds supply of 50% of actual loss to affected Inland Fishermen subject to maximum of Rs.1000/-in case of Co-Op.Society, upto 30% subject to maximum of Rs. 500/- in case of individual and supply of fishing net through loan of Rs.900/- and subsidy of Rs.300/-.

Financial assistance by way of loan of Rs. 3750/- and by way of subsidy Rs. 1250 per animal (cattle)died due to natural calamity for purchase of animals.(75% loan & 25% subsidy).

Financial assistance by way of loan of Rs. 375/- and by way of subsidy Rs.125/- per sheep/goat died due to natural calamiaty for purchase of sheeps/goats.(75% loan & 25% subsidy)

In case of 50% or more damage to crops due to natural calamity financial assistanace upto Rs. 1000/- in cash per hector and upto Rs. 500/- in kind by way of seeds/fertilisers per hector as per special decisions of State Govt. from time to time.

Tahasildars of all Tahasils are empowered to grant assistance as listed above to the sufferers of natural calamity.Following claims are also processed by the Tahasidars concerned.

Assistance of Rs.3000/- to legal heirs of persons died due to natural calamity can be made available through General Insurance Corporation of India under Social Security Scheme of Govt. of India . Eligibility conditions are 1) Annual income of the family not to be more than Rs. 7200/- 2) Age of the earning deceased should be within the age group of 18 to 60 years.

Assistance of upto Rs.2000/- in case of death, upto Rs. 2000/-in case of loss of two limbs and 2 eyes or 1 limb and 1 eye and upto Rs. 1000/- in case of loss of 1 limb or 1 eye can be made available under Maharashtra Shramjivi Kutumb Kalyan Yojana. Eligibility conditions are :

1) Sufferer must be a resident of Maharashtra state Atleast for 15 years
2) Age between 16 to 65 years.
3) Annual income of the family shall not be more than Rs.6000/-.

Q.5 How a permission for construction of water course through the land belonging to other persons can  be obtained?

Ans:

1. In case of any objection for construction of water course the person desiring to construct water course has to apply in prescribed from to Tahasildar.

2. Actions taken by the Tahasildar on receipt of such application. Inquiry as to necessity of water course for full and efficient use of Agriculture land. Grant of permission for constrution of water course as early as possible and to ensure that :

a) alignment to be such as to cause little damage to land and cover shortest distance
b) underground pipes are laid at more than 0.5 m. depth; and
c) width of open water channel does not exceed 1.5 meter. to determine amount of compensation and its  apportionment amongst affected cultivators and to recover the same as arrears of land revenue if not paid by the applicant.

Applicant authorised to enter up on neighbour's land for construction of water course.
Applicant to maintain the water course to its proper state of repairs.

Neighbouring holder has a right to use surplus water on payment of such rates as fixed mutually or in case of dispute by the Tahasildar.

No appeal against the order of Tahasildar. Collector can,however, take up the matter in revision.

Wilful injury or damage to water course entails fine not Exceeding Rs.100/- every time

On discontinuing the water course, applicant to restore   fill in the land to bring it to its original position at his own cost.

Water rates:

i) When used for agriculture Re. 1/- per year
ii) When used for Non-agricultural use (Rate per ten thousand cubic feet of water)

Industrial purpose: 

Rs. 8 for the first two years.
Rs. 10 for the third year, and onwards.

Purpose of Municipalities : Rs. 5/-.

Purpose of the Railway : Rs.12.50

Domestic use (Drinking water etc.): Nil

Q.6 What is the procedure for registration of Daily, weekly, fortnightly, monthly, tri-monthly and yearly Newspapers, Magazines?
Ans.

As per the provisions of Press and Registration of Books Act 1867 a person interested in starting a new News paper (daily or periodically) is required to contact the District Magistrate or the Sub Divisional Magistrate or Magistrate of Police exercising the full powers of a First Class Magistrate, within whose local jurisdictions, the proposed News paper shall be printed or published and file a declaration before him in the prescribed form available with the magistrate. Declaration should contain the proposed Title/s under each periodicity and other particulars of the proposed Newspaper as are asked for.

  • Such declaration for verification of a Title should be submitted to the District
Magistrate concerned (For Nagpur district Additional District Magistrate) authorized under the Press and     Registration of Books Act 1867. The form of application for verification of these Titles proposed is given in Appendix 1
  • After making an inquiry, the District Magistrate concerned shall forward the declaration/application under his signature and office seal as required under the said Act to the office of the Assistant Registrar of News Papers, Regional Office A-1 wing, ground floor, CGO Complex, C.D.D. Belapur, New Mumbai- 400 014 for verification or availability of one of the proposed titles.
  • On receipt of the declaration/application from the District Magistrate concerned, the Registrar shall verify the availability of the proposed titles as per the provisions of Press and Registration of Books Act 1867 from the list of titles maintained centrally in the office of the Registrar of News papers for India, New Delhi.
  • The relevant provisions to Section 6 of the P&RB Act, inter alia state that the News paper proposed to be published does not bear a title which is same as or similar to that of any other News paper published either in the same language or in the same State.
  • After verification the Asst. Registrar of Newspaper submits a proposal to the head office that is Registrar of Newspapers for India, New Delhi for sanction. The Registrar of Newspapers after approval of the title sanctioned to the owner communicates the result to the District Magistrate concerned.
  • The DM concerned shall obtain declaration in the prescribed form No. 1 (See rule 3 of the Act) from the publisher/printer (separate declaration should be filed by the printer and publisher unless the printer and publisher is the same person). Four copies of the declaration should be filed. After receipt of the declaration the DM concerned shall grant permission in the same declaration form for publishing the said Newspaper.
  • It is important to note that, the Registrar of Newspaper for India shall intimate the result to the DM concerned. A copy of the verification letter either allowed or refused is also sent to the applicant / owner. However, the Magistrate is also required to communicate the result of the verification to the intending Publisher. It may be noted that application for title verification by the interesting publisher/owner shall be made by him to the magistrate concerned and not directly to the office of the Registrar of Newspapers for India. The name of the owner shall invariably be very clearly indicated in the application/declaration.

Q.7 What is the procedure for grant of Freedom Fighter Pension of Govt. of Maharashtra to the under ground freedom fighters and who have undergone imprisonment?
Ans. 

A person who claims to be an underground freedom fighter or claims to have undergone imprisonment during freedoms struggle can apply for grant of freedom fighter pension of State Govt. of Maharashtra, as detailed below.

The person concerned shall make an application in the prescribed form in duplicate available in the office of the Collector (Freedom Fighter Cell) affixing a court fee stamp of Re. 1/- on the original copy of the application to the Collector concerned under whose jurisdiction the person concerned is residing. Following documents should support the application.

  • Document showing that the applicant was required to leave his residence/home and stay outside during freedom struggle.
  • Document showing that the applicant was required to leave his education or his name was rusticated from the said educational institution.
  • Certificate from two freedom fighters in that area who either undergone imprisonment for 2 years or remained underground during freedom struggle and their affidavit and copy of their Sanmanpatra.
  • Document showing that the applicant got handicapped due to assault by the Police.
  • News paper cuttings of the relevant time showing that the applicant remained underground during the freedom struggle.
  • Document showing the period of imprisonment undergone by the applicant.
  • Certificates showing the arrest warrant issued against the applicant.
  • Copy of Court’s Order declaring the applicant to be underground.
  • Certificate of date of birth.
(Only attested copies of aforesaid documents should be filed with the application)

Upon receipt of the application from the applicant, the Collector scrutinizes the application through respective tahsildar in whose jurisdiction the applicant is residing. After completion of scrutiny the case of the applicant is submitted before the Zilla Gaurav Samiti for recommendation the Zilla Gaurav Samiti further scrutinizes the claim of the applicant and if finds it fit and according to the guidelines contained in Government of Maharashtra in General Administration Departments GR No. POS – 109/127/FF Cell, dated 4.7.95 recommends the case of the applicant for grant of freedom fighter pension to the Government in General Administration Department for being submitted to the high power committee for sanction. The decision of the Government / high power committee is final in this regard. If Government sanctions the Freedom Fighter pension to the applicant, it issues an order to that effect to the Collector of the District with a copy to the applicant also. Upon receipt of the order, the office of the collector (Freedom Fighter Cell) calls the applicant with instructions to get the following things done for release of pension.

  • The applicant shall open an account in the Nationalised Bank in his name situated nearby the place of his residence and inform the account no. to the office of the Collector for depositing the amount of monthly pension.
  • The applicant shall file an affidavit to the effect that he has not received any amount towards freedom fighter pension ever before.
  • The applicant shall execute an agreement with the Collector in the prescribed form.
  • The applicant shall produce five passport size photographs for this purpose.
After completing the above formalities by the applicant, arrears of pension if any and also the regular monthly pension are paid to the applicant.

NOTE :- It may be noted in the aforesaid whole procedure that the Zilla Gurav Samiti can reject the application of the applicant if it is not supported by the required documents.

Q.8 What are the other benefits to which the Freedom Fighter is entitled?
Ans.

The freedom fighter is entitled to the following benefits :

Medical Assistance The Freedom Fighters Suffering From Fatal Diseases

This assistance is provided to the freedom fighter once in the life, Rs. 5,000/- are granted towards this benefit to the freedom fighter. For this purpose the freedom fighter is required to make an application to the collector on plain paper affixing a court fee stamp of Re. 1/- supported by the Certificate from Civil Surgeon indicating that the applicant is suffering from the scheduled disease and requires to undergo prolonged treatment. The above document such as a copy of pension order, Sanman Patra, I-Card etc. should also be enclosed with the application. The scheduled diseases for which this benefit is granted consist of following :

    1. Tuberculosis
    2. Cancer (All types)
    3. Leprosy
    4. Handicapness
    5. Paralysis
    6. Mental depression
    7. Heart diseases
Financial Assistance For The Marriage Of Daughter/s

The application of plain paper affixing Re. 1/- stamp to be made to the Collector supported by the documents viz.,
1) Copy of Pension order
2) I-Card
3) Sanman patra
4) Daughter’s school leaving certificate
5) Marriage Card of both parties

Upon receipt of application with necessary documents, the collector calls for the report of Tahsildar concerned in his jurisdiction the applicant is residing as to the genuineness of the marriage claim, after receipt of positive report from the Tahsildar financial assistance of Rs. 5,000/- is granted to the freedom fighter. The freedom fighter is entitled for this assistance for the marriage of his all daughters.

Financial Assistance For Funeral Of The Freedom Fighter

Upon death of self freedom fighter his widow or legal heir / dependent can apply for the financial assistance by writing an application on plain paper affixing court fee stamp of Re. 1/- and supported by following documents.

1. Copy of death certificate of deceased freedom fighter duly attested
2. Copy of pension order
3. Copy of I-Card
4. Affidavit indicating all details about the legal heirship and that the person claiming the assistance has performed the last rights of the deceased freedom fighter.
5. Copy of ration card, Bank passbook.

If a widow freedom fighter expires financial assistance of Rs. 1000/- is given to her dependent / legal heir

Free Traveling Concession

The freedom fighter is entitled to travel free of cost by ST bus within the Maharashtra State once in a financial year. If the freedom fighter is not desirous to avail this concession, upon giving undertaking in writing the freedom fighter may get an amount of Rs. 500/- in cash for each financial year. While availing free travel concession, one person can accompany the freedom fighter during journey free of cost. Additionally the freedom fighter can travel along with one person free of cost at one historical place in the State of Maharashtra during that financial year.

For getting free travel concession, the freedom fighter has to opt, first of all for this facility. Thereupon free travel concession pass is issued to the freedom fighter by MSRTC authorities.

Nomination of One Legal Heir For Employment In Government Department.

The freedom fighter can once nominate one of his legal heir for getting employment in the State Government Department in class III or class IV cadre as per the educational qualification of the nominated person. The legal heir consist of following :
1 ) Son
2) Unmarried daughter
3) widow daughter
4) divorced daughter
5) daughter-in-law
6) Nephew from real sister’s side
7) Nephew from real brother’s side and
8) Son or daughter by way of adoption.

For this purpose the freedom fighter is required to make an application on plain paper affixing Re. 1/- court fee stamp supported by copy of pension order, I-Card, Sanman patra, copy of school leaving certificate, Educational qualification certificates, Caste certificate of the person being nominated for the employment, affidavit stating that he is dependent on the person being nominated for employment and that he has not nominated anybody ever before.

    Upon receipt of application alongwith required documents, the same is scrutinised and a certificate to the effect that the concerned freedom fighter has nominated the said legal heir for employment in State Government Department is issued by the Collector. The person nominated gets the employment as per the seniority and availability of vacancies.
Grant of Widow Pension to the Widow of Deceased Freedom Fighter

Upon the death of freedom fighter, his widow alone can apply for grant of freedom fighter pension granted to her deceased husband. For this, she has to apply to the Collector on plain paper affixing Re.1/- court fee stamp supported by copies of all concerned documents of the deceased freedom fighter such as attested copies of death certificate, pension order, I-Card, sanman patra, ration card, Bank passbook and affidavit stating that she is a widow of deceased freedom fighter and hence, is entitled to receive the pension.

Upon receipt of application the office of the Collector scrutinises the same and grants freedom fighter pension to the widow of deceased freedom fighter and issues order to that effect.

Q.9 What is the procedure for getting Income Certificate?
Ans. 

For getting Income Certificate one has to apply to the Tahsildar in whose jurisdiction the applicant resides on plain paper affixing a court fee stamp of Re. 1/- supported by following documents.

  • Document showing the applicant of being resident of that Taluka.
  • Document showing immovable property held by the applicant in that Taluka and if not Certificate to that effect from the Talathi.
  • Certificate from Talathi about the Income of the applicant / Certificate of Income from the office if the applicant is serving in Govt. Department.
  • Details of Family income from Agriculture Land, Business, House Rent, Dairy Business, Interest on investment etc. i.e. income from all sources.
  • Affidavit of applicant on 20 Rs. Stamp paper about his income
If the applicant fulfills the requirement of necessary documents, he can get Income certificate within a day. from the Tahasildar concerned.

Q.10 What is the procedure for getting Solvency Certificate?
Ans.

For this purpose the applicant has to apply to the following authorities as per the requirement of quantum of amount of solvency certificate.

A) Upto 25,000/- Naib Tahsildar.
B) Upto 25,001 to 1,00,000/- Concerned Tahsildar
C) Upto 1,00,000 to 5,00,000/- Concerned Sub Divisional Officer
D) Rs. 5,00,000 and above Collector

The applicant should apply on plain paper affixing court fee stamp of Re. 1/- thereon supported by following documents.

  • Document showing the applicant of being resident of that Taluka.
  • Document showing the property held by the applicant in that Taluka e.g. 7/12 extract or ownership title document.
  • In respect of agriculture land, the valuation report from the Talathi of the land held by the applicant under the said 7/12.
  • Affidavit of the applicant on a stamp paper of Rs. 20/- giving details of property held by him. and details of charges, encumbrances thereon.
The applicant can get this certificate within 2 days if he fulfills the requirements of aforesaid documents.

Q.11 What is the procedure for grant of Ration Card?        
Ans.

Documents required for new ration card.

  • Application in prescribed proforma.
  • Proof of being original resident within the jurisdiction of competent authority.
  • Certificate of cancellation of ration card of the place where the applicant was residing earlier or if the applicant does not have ration card, certificate from the Tahsildar or Food grain distribution officer of that earlier place of residence to that effect.
  • Affidavit to the effect that the applicant was not holding ration card earlier or it was got cancelled.
  • Cost of ration card Rs. 5/- ( if desires to have duplicate ration card in the event earlier is lost, it is theft, etc., application with necessary proof, affidavit and cost of ration card Rs. 10/- )

    For adding new names in the ration card.

    • For adding the name for the first time, birth and resident certificate.
    • Certificate of having deleted the names from earlier ration card as a result of transfer, marriage, shifting etc.
    • Certificate to the effect that the said name has not been included or remained to be included in the ration card.

    For deleting the name from the ration card.

    • Application of ration card holder.
    • Reason/ details for deleting the name.

    For grant of temporary ration card.

    • Application in prescribed form along with residential proof.
    • Period of temporary stay and reason thereof.
    • Documentary proof showing place from where transferred.
    • Cost of ration card Rs. 5/

    Inquiry procedure

    The genuineness of the contents mentioned in application, affidavit, and other documentary proof is verified by the supply inspector concerned.

    The applicant can get the ration card within 7 days if he fulfills requirement of necessary documents.

Q.11 What is the procedure for getting Domicile Certificate?
Ans.

For getting this Certificate one has to apply to the concerned Sub Divisional Officer in whose jurisdiction the applicant ordinarily resides or to the Additional District Magistrate at the District Headquarter. The documents required for this purpose are:

  • Application in the prescribed form affixing Re.1/- Stamp thereon.
  • Documentary proof showing that the applicant has been residing in the said Taluka since his birth.
  • School leaving Certificate.
  • Documentary proof showing the immovable property held by the applicant such as Tax Receipt, Agriculture land record, Ration Card, Election I-Card Etc.
  • One can get this certificate within 2days if he fulfills the requirement of necessary documents.

Q.12 What is the procedure for getting caste certificate for Scheduled Caste?
Ans.

For this purpose the applicant has to apply in the prescribed form enclosing thereto following documents to the concerned competent authority viz, the Sub Divisional Officer, or the Deputy Collector duly empowered for issue of caste certificates. Documents to be enclosed are:

  • School leaving certificate of the applicant
  • Documentary proof showing the caste of the applicant, his father, or blood relations. ( for example birth and death certificate, school leaving certificate, entries in service book etc. )
  • Documentary proof showing the applicant, his father or family having been residing permanently within the jurisdiction of the competent authority since 6/9/1950 ( e.g. extract of house property, agriculture land, tax receipt or other relevant documents.
  • Affidavit on Re. 20/- Stamp paper wherever necessary.
If the applicant fulfills requirement of necessary documents, decision on his application can be communicated to him within 8 days.
If the decision of the competent authority is not acceptable to the applicant, he can file an appeal within a period of 30 days from the communication of the order passed by the competent authority before the Scheduled Tribe Caste certificates verification committee.

Q.13 What is the procedure for getting Scheduled tribe Caste certificate?
Ans.

The concerned Sub Divisional Officer in whose jurisdiction the applicant resides or the Deputy Collectors empowered for the purpose are the competent authorities in this regard.

The applicant has to apply in the prescribed form enclosing thereto the following certificates :

  • School leaving certificate of the applicant
  • Documentary proof showing the caste of the applicant, his father, or blood relations. ( for example birth and death certificate, school leaving certificate, entries in service book etc. )
  • Documentary proof showing the applicant, his father or family having been residing permanently within the jurisdiction of the competent authority since 06/09/1950 ( e.g. extract of house property, agriculture land, tax receipt or other relevant documents.
  • Affidavit on Re. 20/- Stamp paper wherever necessary.

Ans.

The competent authority for this scheme is concerned Tahsildar in whose jurisdiction the applicant resides. Committee decides loan claims. Loan not to exceed Rs.2500/- for small occupation.

The applicant has to apply in the prescribed form available free of cost alongwith following documents.

  • Eligibility certificate of the occupation of the unemployed person intending to run the small business.
  • Recommendation letter of the concerned corporator or Sarpanch.
  • Family income certificate.
  • Receipt of property tax.
  • Photocopy of Ration card and election I-card.
Eligibility of the person to get this loan :
  • The applicant should be an unemployed youth / person.
  • He should have at least 5 years permanent residence of Maharashtra State.
  • The applicant should not have his original business.
  • Applicant should be eligible for doing the intending business.
  • There should not be any earning member in the applicant’s family.
  • Applicant must have capacity to repay the loan.

Q.21 What is the procedure for getting financial assistance under Sanjay Gandhi Niradhar Scheme?
Ans.
The competent authority for this purpose is concerned Tahsildar in whose jurisdiction the applicant resides. The applicant has to apply in the prescribed application form, which is available free of cost. Following documents should support the application.
  • The disabled female above the age of 60 and the disabled male above the age of 65 should produce certificate of their age in duplicate from the Civil Surgeon / Medical officer.
  • If the applicant is a disabled person suffering from cronic disease, handicapped, mental retardedness, he should produce certificate in duplicate to that effect from the Civil Surgeon / Medical Officer.
  • 2 passport size photographs of the applicant.
  • Certificate from corporator / Gramsevak / Sarpanch.
  • Certificate showing resident of Maharashtra State since birth.
  • The aged female/male should not be a beggar, should not have been getting financial assistance from any institution and he or she should not have any source of income to earn his / her livelihood.
